फरीदाबाद 12 सितम्बर 2021: साहिल विरमानी ने करण गंभीर को लीगल नोटिस भेजा है और उनके आरपों को गलत बताया है, आपको बता दें कि करन गंभीर ने साहिल विरमानी और उनके पिताजी पूर्व मेयर पर एक इंडस्ट्रियल प्लाट को एग्रीकल्चर लैंड में बदलकर नीलामी के जरिये नगर निगम को करीब 25 करोड़ रूपया चूना लगाने के आरोप लगाए थे. इन आरोपों को झूठा बताकर साहिल विरमानी ने करण गंभीर को लीगल नोटिस भेजा है और उन्हें चेतावनी दी है कि 24 घंटे के अंदर लिखित माफी मांगे और उनका इंटरव्यू Facebook Page Haryana Abtak और Faridabad Latest News से हटवाएं वरना उनके खिलाफ और Facebook Page Owner के खिलाफ कानूनी कार्यवाही होगी।

Under instructions from and on behalf of my client Mr Sahil Virmani Director M/s Mars Infraengineering Pvt. Ltd., having it’s office at 660, Sector 16A, Faridabad, I am issuing the following legal notice to you, in the light of your untrue, mala fide and deliberate culpably defamatory statements made publicly against my client, uploaded in electronic and social media.
1. That it has come to the notice of my client on 10.09.2021 that you addressee have posted a defamatory video regarding my client on “www.haryanaabtak.com” (https://www.facebook.com/
2. That my client is the Director of the Company M/s M/s Mars Infraengineering Pvt. Ltd., having it’s office at 660, Sector 16A, Faridabad and enjoys good reputation in the city of Faridabad.
3. That you addressee is Ex-Director of the company M/s Forgings Pvt. Ltd who availed credit facilities from M/s Indiabulls Housing Finance Ltd. against the security of the land belonging your Company admeasuring 8.84 Acres, situated at Village Sarai Khawaja, Delhi Mathura Road Highway, Tehsil Badkhal Faridabad (hereinafter referred to as “Said Land”).
4. That when M/s Forgings Pvt. Ltd failed to repay the loan availed from M/s Indiabulls Housing Finance Ltd, a Petition U/s 7 of the Insolvency & Bankruptcy Code, 2016 bearing NO. CA No. 455 (PB)/2019 titled “Indiabulls Housing Finance Ltd. Vs Forgings Pvt. Ltd” was filed before the Hon’ble NCLT, New Delhi Principal Bench, which was allowed vide order dated 28.03.2018 and Mr. Sanjeve Bhushan Deora was appointed as Liquidator
5. That the Said Land was thereafter put to open auction on dated 07.06.2020. M/s Mars Infraengineering Pvt Ltd having its office at 660, Sector 16A Faridabad jointly with Mr. Devender Kumar R/o H.No. 52, Sector 16-A Faridabad were declared as successful bidders by the Liquidator for a sum of Rs. 52.83 Cr,
6. That the sale of the Said Land, in the open auction by the Liquidator was challenged by you addressee before Hon’ble NCLAT, New Delhi in Company Appeal (AT) (Insolvency No. 1420 of 2019) titled Mr. Karan Gambhir Ex. Director, Forgings Pvt. Ltd. Vs Mr. Sajeve Bhushan Deora (Liquidator for Forgings Pvt. Ltd. & Others) which was dismissed vide judgement dated 17.08.2020
7. That thereafter Civil Appeal No. 3103 -3104/2020 against the judgement dated 17.08.2020 tilted Karan Gambhir Vs Sajeve Bhushan Deora & Others was filed before the Hon’ble Supreme Court of India which was also dismissed vide order dated 12.01.2021
8. That Mr. Devinder Kumar, one of the joint successful bidders of the Said Land passed away on dated 09.05.2021. An application bearing No. IA-2739/2021 was filed before the Hon’ble National Company Law Tribunal, New Delhi to place on record the legal heirs of Mr. Devinder Kumar, namely Sh. Vidyavati (Mother), Ms. Savita Girdhar (Wife) and Mr. Abhishek Amir Girdhar (Son) in his place, for registration of the Said Land purchased by Mr. Devender Kumar in the open auction which was allowed vide order dated 06.07.2021.
9. That thereafter the Liquidator has executed the Sale Deed of the said land in favour of M/s Mars Infraengineering Pvt Ltd jointly with the legal heirs of Mr. Devender Kumar, namely Sh. Vidyavati (Mother), Ms Savita Girdhar (Wife) and Mr Abhishek Amir Girdhar (Son) and duly registered in the records of Sub-Registrar Badhkal, Faridabad.
10. That in view of the aforesaid, the Sale Deed of the said land has been executed after following the due procedure of Law, upto the highest judicature of the Country i.e. Hon’ble Supreme Court of India wherein you were also a party to the proceedings.
11. That despite of the above, you addressee with mala fide intention have deliberately given culpably defamatory statement publicly against my client which has been uploaded in electronic and social media particularly “Haryana Abtak” and “Faridabad Latest News” video page on Facebook. The video posted on “Haryana Abtak” has been liked by viewed by 2900 persons, liked by 54 persons and shared by 9 people as till 12:37 pm on 11.09.2021.
12. That on a bare perusal of the impugned post which is being circulated on the social media particularly Facebook page of Haryana Abtak and Faridabad Latest News, makes it abundantly clear that you addressee has purposefully made the scandalous imputations against my client with the culpable malicious intention to defame my client’s reputation in the eyes of the General Public and thereby spread untrue, false and scandalous imputation against my client alleged to have removed the concerned files of the Said Land from the office of MCF Faridabad and cheated the MCF.
